We provide professional tax debt negotiation and advisory services, including but not limited to:
- Liaising and negotiating with the Inland Revenue Department (IRD) on behalf of clients;
- Providing advice and assistance with tax arrears, instalment arrangements, and hardship applications;
- Offering guidance on tax compliance and debt management strategies.
All services are provided on a best-efforts basis — while we aim to achieve favourable outcomes, results cannot be guaranteed as final decisions rest with IRD or other authorities.
3. Client Responsibilities
By engaging our services, you agree to:
- Provide accurate, complete, and truthful information as requested;
- Supply all relevant documents needed to assess and negotiate your tax position;
- Authorise us to communicate with IRD on your behalf (usually via Form IR597 or nominated person access in myIR);
- Comply with any payment obligations set out in our engagement letter or invoice;
- Keep your contact and financial information up to date.
Failure to provide accurate or timely information may limit our ability to assist you or result in termination of service.
4. Fees and Payment
Our fees are set out in your Engagement Letter or Service Agreement. Unless otherwise stated:
- Fees are quoted exclusive of GST;
- Payment is due as per the terms stated on our invoice.
- Late payments may incur collection costs or suspension of services.
In some cases, we may request an upfront retainer or deposit before commencing work.
5. Confidentiality
All client information provided to us is treated as strictly confidential.
We do not disclose your information to third parties except:
- As authorised by you;
- As required by law; or
- To IRD or professional advisers where necessary to perform our services.
Confidential information will be handled in accordance with our Privacy Policy and the Privacy Act 2020.
6. Limitation of Liability
While we take care in delivering accurate and timely advice, Tax Debt Advisory Limited shall not be liable for any loss, damage, or expense arising from:
- IRD decisions or actions beyond our control;
- Errors or omissions based on incomplete or inaccurate information provided by you;
- Delays in processing or communications by IRD or third parties.
To the maximum extent permitted by law, our total liability (whether in contract, tort, or otherwise) is limited to the amount paid by you for the specific service giving rise to the claim.
7. No Legal or Financial Guarantee
Our services aim to negotiate and advocate for your best outcome with IRD. However:
- We cannot compel IRD to accept a particular arrangement;
- We do not guarantee remission, write-offs, or acceptance of proposals;
- Advice provided is general and based on information supplied at the time.
You should seek independent legal or accounting advice where required.
8. Termination of Services
Either party may terminate the service agreement by giving written notice as mentioned in our engagement letters.
We may terminate our services immediately if:
- You fail to pay fees when due;
- You provide misleading or incomplete information; or
- Continuation of the engagement would breach professional or ethical obligations.
On termination, all outstanding fees become immediately payable.
9. Intellectual Property
All website content, materials, templates, and resources provided by Tax Debt Advisory Limited are owned by us and protected under copyright law. You may not reproduce, distribute, or adapt any content without our prior written consent.
10. Website Use
When using our website, you agree to:
- Use it only for lawful purposes;
- Not engage in any activity that disrupts or interferes with website functionality;
